Responsibilities of a Bail Bond Co-Signer

At Monopoly Bail Bonds, we know co-signing a bail bond is a meaningful way to support a loved one during a difficult time. But before you agree to take on this role, it’s important to fully understand your legal and financial responsibilities as a co-signer in Texas — especially here in Fort Bend County.

A co-signer, also known as an indemnitor, guarantees that the defendant will follow all court-ordered conditions after being released on bail. In other words, you’re stepping in as a responsible party, promising the defendant will attend court and comply with any other terms set by the court or bail bond agreement.

👤 What You’re Agreeing To as a Co-Signer

By signing a bail bond contract with Monopoly Bail Bonds, you agree to:

  • Ensure the defendant appears at all required court hearings
    If the defendant misses court, the bail bond may be forfeited — and you could be held liable for the full bail amount.
  • Cover the full bail amount if the defendant flees or violates conditions
    If the defendant skips bail and cannot be located within the required time (usually 180 days in Texas), you’ll be financially responsible for the entire bond amount, which could range from thousands to hundreds of thousands of dollars.
  • Pay all applicable fees, premiums, and outstanding balances
    You are responsible for ensuring the bond premium (usually 10%) is paid in full, either upfront or through an approved payment plan.
  • Maintain contact with Monopoly Bail Bonds
    You may be required to stay in touch with us and update any changes to your address, phone number, or employment status while the bond is active.
  • Assist in locating the defendant if necessary
    If your loved one attempts to flee, you’re expected to cooperate with us and law enforcement to help locate and return the defendant to custody. Failing to do so can increase your financial risk.
  • Understand and manage collateral, if applicable
    If you put up property or assets as collateral for the bond, you risk losing it if the defendant fails to appear and the bond is forfeited. However, if all conditions are met, collateral is returned after the case is resolved.
